Vacation Rental Agreement
THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THIS PROPERTY AFTER RECEIPT OF THE AGREEMENT IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.
1) THIS AGREEMENT MUST BE SIGNED AND RETURNED WITHIN 7 DAYS of the date of the agreement. If this agreement is not returned within 7 days, Guest reservation may be cancelled at the sole option of the Owner. The amount specified as the security/damage/cleaning deposit is due along with this agreement (within 7 days). This payment may be paid in the form of personal check or money order. This check will not be deposited into an account, but rather, will held by Owner, and will be returned if all agreements are met as stated in paragraphs 8 and 12. All security deposits will be returned within forty-five (45) days of termination of occupancy plus
any deductions authorized pursuant to the North Carolina Security Deposit Act.
2) THE FULL BALANCE FOR RENTING THE STATED PROPERTY is due in full within 3 weeks of date of occupancy of rental.This payment can be in the form of personal check, cashiers check or money order and is a separate check from the security deposit check required in paragraph 1. This agreement shall not be binding unless and until the Owner has received the amount specified and all checks have cleared the bank. For all returned checks, there is a $25.00 handling fee. For reservations made less than 3 weeks from check-in, all funds are immediately due. All reservations must be paid in full prior to check-in. A vacation rental agreement must be signed prior to check-in.
3) DIRECTIONS AND DOOR CODE will be e-mailed after all payment/s has been received in full.
4) TAXES as required by North Carolina include the collection of sales tax at current rate for goods and services charged to Guest. Taxes are subject to change.
5) CHECK-IN/CHECK OUT: Check-in will be after 4 pm on the arrival date with no early occupancy request. Check out on the date of departure will be by 11 am.
6) CANCELLATION must be in writing and received by Owner. In the event Guest wishes to terminate this agreement, 100% of the total rental amount shall be returned if cancellation is made more than 30 days in advance of the arrival date (0% forfeited). If cancellation is received within 19 to 14 days of the arrival date, 50% of the total rental amount shall be returned (50% forfeited). If cancellation is received within 13 days of the arrival date, 0% of the total rental amount shall be returned (100% forfeited). However, if such rental property is re-rented for the same period of time, all monies will be returned less a $100.00 administration fee.
7) TERMINATION. If the Guest or any member of the party violates any terms of this agreement the Owner may, at the Owner’s sole discretion, terminate this
contract with no refund of the rent unless the property is able to be re-rented. The Owner may enter the property and remove Guest, the members of
the party, and their belongings. Guest is notified that they will be subject to expedited eviction procedure pursuant to the “Vacation Rental Act”.
8) SECURITY/CLEANING DEPOSIT: Any security deposit provided for in paragraph 1 above, may be applied to actual damages, extra cleaning (see
paragraph 12), or calls by Guest, as permitted under The Tenant Security Deposit Act. In addition, Owner may deduct from the security deposit the
amount of any unpaid long distance charges not specifically described in this agreement as being included with the premises. All such charges discovered plus
a $20.00 service fee will be charged. A $25.00 fee, plus shipping costs, applies to any Lost and Found items that the Owner returns to Guest. Items
found and not claimed within 7 days will be discarded at the discretion of the Owner.
9) FURNISHINGS: Locations are fully equipped including mattress pads, pillows, blankets, bedspreads and linens. Paper goods and cleaning supplies are also provided.
10) MAINTENANCE: Malfunction of appliances or service requests for air conditioning (if applicable), televisions, hot tubs, appliances etc., will be responded to as quickly as possible. There will be no rebates or refunds issued to Guests for any reason if every good faith effort is made to ensure the property is maintained to
highest standards. Guest is to maintain property as if it were their own. PLEASE REPORT ANY PROBLEMS OR DAMAGES IN YOUR UNIT THE DAY OF CHECK-IN TO
OWNER. IF NOT REPORTED WE MUST ASSUME THE DAMAGE OR LOSS OCCURRED DURING YOUR OCCUPANCY AND WE WILL HAVE TO CHARGE YOU. Guest must follow all rules specified for Hot Tub. Rearranging furniture is not permitted.
11) NO SMOKING allowed inside any location. When in violation of the smoking policy, Guest agrees to pay all costs associated with cleaning to remove smoke
odors, in addition to any losses incurred by Property Owner, and a $25.00 handling fee. If you do smoke outside, do not throw your cigarette butts on the
ground, but rather please place them in the trash after they are extinguished.
12) CHECK OUT PROCEDURES: On departure guest(s) are required to leave the property in the same general condition it was when guest(s) arrived. If
additional cleaning is required, appropriate charges will be deducted from you security deposit. The following items must be complied with before check out:
a) All trash removed to locations specified at property.
b) Dishes,pots,pans,and utensils are washed, dried and put away
c) All doors and windows closed and locked
d) All lights are turned off to conserve energy.
e) In winter months, thermostat is set to 60 degrees and fire place logs thermostat set to “off” position.
f) All keys returned to lock box
g) At least one load of linens washed per 2 guests.
h) Stove,oven,microwave,and kitchen appliances are clean.
i) Gas grill is clean.
j) Use vaccum/s provided as needed to clean debris &/or animal hair
Additional specific house instructions/rules are located in the Information Book and to be performed as well.
13) PETS: We are pet friendly because we love our pets and consider them family. Please be respectful & mindful! We do not charge a per-night fee or a non-refundable security deposit. The Owner/Guest understand that:
a. Guest will be asked to make an additional Cleaning/Damage deposit.
b. Outside the premises, all pets must be on a leash or supervised by an adult. No pet shall be tied outside the unit unless supervised by a
responsible adult.
c. Guest is responsible for cleaning the area around Rental Property of all pet excretions.
d. Pet hair must be removed (vacuumed) from all furniture, bedspreads, beds, etc., or Guest will be charged full cleaning/damage deposit.
e. Any pet material damage to the property (for example, chewing furniture or urinating on carpet, etc.) will be the responsibility of the Guest, and shall be paid immediately upon notification of Owner.
f. Guest agrees to not have any other pet on property other than the pets stated in this agreement.
g. Absolutely no pets, under any circumstances are allowed in Hot Tub.
h. Failure to meet any of the above forfeits the ENTIRE deposit made on your specific location
14) HOT TUBS AND COVERS: Read spa/hot tub warnings and instructions before use located in information book in-house. Hot tub will be inspected after each rental. If any items such as food, alcohol, soaps or bath products, etc. are found in the hot tub, you will be charged an excessive cleaning fee of $50. Damage to any cover will result in a $200.00 charge. Covers should remain on the hot tub at all times when not in use.Children under the age of 16, pregnant women and persons with heart
conditions or skin sensitivities should not use the hot tub.
15) NO REFUNDS DUE TO CHANGE OF PLANS OR EARLY DEPARTURES. Refunds may be given, upon discretion of owner, if a significant snow or ice storm occurs.
16) DRIVING CONDITIONS: Mountain roads can be tough at any time of the year. We do not guarantee any road surface conditions. Most roads in our area are well
maintained, however Wolf Branch Cabin Road is NOT maintained during a snow/storm. Wolf Branch Road is a dirt/gravel road. While these roads are routinely maintained they may/will be bumpy at times. In the late fall, winter, and early spring it is not uncommon to occasionally have hazardous road conditions. It is strongly recommended that all guests have four-wheel drive/All Wheel Drive. Winter road conditions and maintenance are not guaranteed. You are responsible for your transportation. We cannot provide any transportation for guests nor are we responsible for any towing charges you may incur during your stay.
17) IN THE EVENT that the Owner is unable to deliver the said location to Guest under this lease agreement prior to stay because of fire, eminent domain, act of nature (i.e. snow), double booking, or any other reason whatsoever, Guest hereby agrees that Owner sole liability as a result for these conditions is a full refund of all consideration previously tendered by Guest.
18) INDEMNITY. The Guest agrees to release and indemnify the Owner from and against all liability should anyone be injured upon the premises during the term of the stay resulting from any cause whatsoever except in the case of personal injury caused by the negligent act of the Owner.
19) ACKNOWLEDGEMENT. Guest has acknowledged that they have reviewed and understand the terms of this agreement and agree to be bound thereby.
